Ontario Severance Law

Under Ontario's Employment Standards Act (ESA), terminated employees are entitled to 1 week of notice per year of service (minimum 1 week, maximum 8 weeks). Beyond ESA minimums, common law reasonable notice — governed by the Bardal factors (years of service, age, position, availability of similar employment) — typically ranges from 1 to 24+ months. Most employers offer only the ESA minimum; DemandPay helps employees recover the difference.

Ontario's Limitations Act, 2002 gives employees two years from their termination date to commence a wrongful dismissal claim. Missing this deadline permanently bars the claim.
